ESMA final report on the guarantees as CCP collateral and CCP investment policy

On 19 October 2026, the European Securities and Markets Authority (ESMA) issued a final report on draft regulatory technical standards (RTS) amending Commission Delegated Regulation 153/2013 in relation to public guarantees, public bank guarantees and commercial bank guarantees as collateral and in relation to certain aspects of investment policy and highly secure arrangements for the deposit of financial instruments

Consultation

The final report follows a consultation on the draft RTS that ESMA issued on 23 February 2026. The consultation ended on 30 April 2026. ESMA also held a public hearing on the consultation on 23 April 2026.

Next steps

ESMA will submit the final report and draft RTS to the European Commission. The Commission then has three months to decide whether to adopt the RTS (in the form of a Commission Delegated Regulation). Following the adoption, the RTS are then subject to non-objection by the European Parliament and the Council.
